These Terms and Conditions ("Terms") constitute a legally binding agreement between you and PACIFIC IT SOLUTIONS AB, doing business as Preventer.ai, organization number 559445-2822, registered at Ängsullsvägen 153, 162 46 Vällingby, Sweden.
These Terms and Conditions ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and PACIFIC IT SOLUTIONS AB, doing business as Preventer.ai ("Preventer.ai", "we", "us", or "our"), concerning your access to and use of the Site, our AI software, and any related media, mobile applications, cloud-hosted services, developer APIs, documentation, and support (collectively, the "Services"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, do not access or use the Services. We may update these Terms from time to time by posting a revised version with an updated "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the revised Terms
Unless otherwise indicated, the Services are our proprietary property and all source code, models and model outputs, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content") as well as the trademarks, service marks, and logos (the "Marks") contained therein are owned or controlled by Preventer.ai or licensed to us and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and to download or print a copy of any portion of the Content to which you have properly gained access solely for your internal business purposes. No rights are granted except as expressly set forth in these Terms.
You are responsible for safeguarding your account credentials and all activities conducted under your account.You may be required to register an account to access certain features. You are responsible for all activities that occur under your account. You agree to keep your credentials confidential and to notify us immediately of any unauthorized use. We reserve the right to refuse, reclaim, or change a username in our sole discretion.
Some Services require payment of fees. All fees are payable in SEK unless otherwise specified and are exclusive of VAT and applicable taxes. You authorize us and our payment processors to charge your selected payment method for recurring subscriptions and usage- based charges. We may modify prices upon notice. Billing disputes must be raised within thirty (30) days of the charge. We reserve the right to correct any errors or mistakes in pricing even if we have already requested or received payment.
Subscriptions may be cancelled by contacting support@preventer.ai. Cancellation will take effect at the end of the current paid term. Certain fees may be non- refundable as specified in the applicable Order Form or Plan description.
You may not access or use the Services for any purpose other than those we make available. Prohibited conduct includes, without limitation: (a) copying, scraping, or harvesting Content or user data; (b) reverse engineering, decompiling, or attempting to derive the source code of the Services; (c) interfering with security-related features; (d) uploading malware or engaging in denial-of-service attacks; (e) impersonating any person or entity; (f) using bots, spiders, or automated systems without our prior written consent; (g) violating export control or sanctions laws; (h) reselling, sublicensing, or time-sharing the Services; and (i) using the Services to create or disseminate content that is unlawful, defamatory, infringing, or otherwise objectionable.
The Services may invite you to create, upload, post, display, or transmit content ("Contributions"). You are solely responsible for your Contributions. You represent and warrant that you own or have the necessary rights to your Contributions and that your Contributions do not infringe any third-party rights, contain unlawful material, or violate these Terms.
By submitting Contributions, you grant Preventer.ai a worldwide, non-exclusive, royalty- free, transferable, and sublicensable license to host, store, reproduce, adapt, publish, translate, transmit, and display such Contributions as necessary to operate, maintain, improve, and provide the Services and to meet our contractual and legal obligations. You retain all ownership rights in your Contributions.
Any feedback, suggestions, or ideas you provide regarding the Services ("Submissions") are non-confidential and shall become our exclusive property. We shall have the unrestricted right to use and disseminate Submissions for any lawful purpose without acknowledgment or compensation to you.
We reserve the right, but not the obligation, to monitor the Services for violations of these Terms; take appropriate legal action; remove or disable access to any Content or Contributions; and otherwise manage the Services in a manner designed to protect our rights and facilitate proper functioning.
Your use of the Services is subject to our Privacy Policy available at https://sysvaluet.404minds.com/privacy (or successor URL).
The Privacy Policy explains how we collect, use, disclose, and protect personal data and describes your rights under applicable law, including the GDPR.
These Terms remain in effect while you use the Services. We may suspend or terminate your access immediately, without prior notice, for any breach of these Terms, for suspected fraudulent or unlawful activity, to comply with law, or for operational or security reasons.
Upon termination, your right to use the Services will cease immediately, but provisions that by their nature should survive (including intellectual property rights, disclaimers, limitations of liability, and indemnification) shall survive termination.
We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time with or without notice. We cannot guarantee that the Services will be available at all times.
Interruptions may occur due to maintenance, system failures, or events beyond our control. We are not liable for any loss or inconvenience caused by such interruptions.
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles.
Before initiating formal proceedings, you agree to attempt to resolve the dispute informally by contacting support@preventer.ai within thirty (30) days of the dispute arising.
If not resolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Sweden, unless mandatory law provides otherwise. Nothing in this section limits either party’s right to seek injunctive or other equitable relief.
There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and other information.
We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time, without prior notice.
The Services are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Services will be accurate, reliable, error-free, uninterrupted, secure, or free of harmful components. Outputs generated by AI models may be inaccurate or misleading. You are responsible for reviewing and validating all outputs for your use case.
To the maximum extent permitted by law, in no event shall Preventer.ai, its affiliates, or their respective directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or goodwill.
Our aggregate liability for all claims relating to the Services shall not exceed the amounts paid by you to us for the Services in the twelve (12) months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Preventer.ai and our affiliates, licensors, service providers, and their respective officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your use of the Services.
We maintain certain data that you transmit to the Services for performance and operational purposes. You are solely responsible for all data that you transmit or that relates to activities undertaken using the Services.
We shall have no liability for any loss or corruption of such data, and you waive any right of action arising from such loss or corruption.
Visiting the Site, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that such communications satisfy legal writing requirements.
You agree to the use of electronic signatures, contracts, orders, and records, and to electronic delivery of notices and transaction records.
These Terms constitute the entire agreement between you and us. Failure to enforce any provision does not constitute a waiver. If any provision is deemed unenforceable, it shall be severed without affecting remaining provisions.
You may not assign your rights without our consent. We may assign our rights and obligations at any time.
